Thanks to Sebastian for pointing out this post on the Wired blog about UMG Recording Group’s argument in court filings last week that throwing out promo CDs constitutes an “unauthorized distribution” of those CDs. Basically the record label is suing someone for selling promotional CDs labeled “not for resale” without “requisite proof of first sale”. I’ve actually wondered about that whole labeled “not for resale” thing…perhaps we can talk about that…maybe one of the lawyers wants to give their take.
